Sorry for the absence. I am usually around and throwing in my 2 cents but I found out my groups identity was taken by some producer for his TV show making fun of the paranormal.

I have been a little bummed and out of sorts trying to think of what to do.

Out of all the names in the world they had to take my groups name? :-(

Sorry but I had to whine to someone and get it off my chest… LOL

Sorry to hear about that Kim.

A friend of ours, out of Dallas, Tx, had a business and the name of his company was his own name. Someone that worked for him took over the company and continued to use his name. He wanted the new owner to stop using his name…..even went to court….but because he didn't trademark his name…..he lost all rights to use his name for his new company.

He convinced us into trademarking our company's name so no one else could use it….which we did promptly.

So essentially it is a candid camera/Punk'd kind of show that fakes paranormal crap?

Sorry your name is being used for this. I'm an opportunist – I'd change my group's name very slightly, buy a new web URL and try to sell the GhostBreakers.com URL to the production company for big bucks that I'd turn around and spend on new equipment.

BTW – I had my personal identity stolen a few years ago by someone I worked with. It was a huge nightmare to straighten out. The worst part was that the company I worked for was so $hitty that they didn't do a thing about it other than say, "It's a shame that someone who works for us is so untrustworthy." You think they'd warn other employees and fire the person or something like that.

OMG that sucks. And once it ends will cause problems. I think the changing name and selling the site to the show would be good. Could use some of the money to copyright your new group name. And get some killer equipment.



Remember, dogs and cats are better than kids because they:

(1) eat less,

(2) don’t ask for money all the time,

(3) are easier to train,

(4) normally come when called,

(5) never ask to drive the car,

(6) don’t smoke or drink,

(7) don’t want to wear your clothes,

(8) don’t have to buy the latest fashions,

(9) don’t need a gazillion dollars for college and

(10) if they get pregnant, you can sell their children ..

Kim, this is a major bummer. I'm sorry to hear that this type of show will be using the same name as your group.

The good news is that anyone who is familiar with your team won't associate this show with you at all.

I wish there was something you could do that would prevent them from using your team's name.

Several people have said to drop my site or change my name but I have used it for 34 years and my grandmother beofre that. It's not like I just made it up yesterday and I can't see my way to giving in to someone that just thought they could steal it.

Their show name was different until this past April or so and from my snooping around I am convinced they actually just took the name from me. It's not similar or a variation but the exact name.

I have an attorney looking into it and he thinks I have a good case. I am not one to casue them a lot of grief over it but I think I should make it known that they shouldn't have just taken it.

Yeah – you definitely seem to have some kind of implied ownership of it, that's for sure. It seems like an odd name for someone to just "come up with." Clearly if they did a Google search for Ghostbreakers, they found you…

Yeah, that's true and a good point. If you Google The GhostBreakers, what comes up is the 1940 movie, the book and my group.

Yeah, that's all I ever see when I look for your site, Just read your site from time to time.

I'm sorry! You had your group name for a long time, that has to feel like your group sort of being violated, in a name way.

I think these team names are very personal to the members and mean alot, and signify the people behind them.

So they just used a lower case b, wow! I've never heard of the show, can't even find it on Fox fall listings.

I can't really find anything about the show when I search, just you. /biggrin.png' class='bbc_emoticon' alt='Laugh' /> Hopes that helps, but it's true.

Maybe the show just didn't make it to the air. I see their LLC, good luck with that. It's all designed legally to be really hard to sue.

I agree with Karen, go for it. But, your the capital B anyway, so there's the change.

Maybe that's why they did it, the letter change.

I don't think when names are registered trademark, inc, or llc people really check the internet.

Just legal records.

Maybe you should register your team's name. /smile.png' class='bbc_emoticon' alt=':D' />

Things are ok so far. A representitive from Fox told me the show they are promoting with my groups name was not picked up by the network. I am also awaiting trademark approval. My attorney says there shouldn't be any problems since I have had it so long and it falls under intellectual property laws among others.

I don't understand all the legal mumbo jumbo but according to the attorney, should it get on TV or anywhere else using our name then I am entitled to a piece of the action, so to speak.

Then I have to address the Canadian group that made a video game with our name.

See, the problem is, GhostBreakers as one word is our name. All they would have had to do is call it Ghost-Breakers (with a space) because then it is considered a statement. We shall see how it all pans out.
